General Terms Applicable to all Site Users

Introduction

These terms and conditions apply to all users of P2P HR Solutions’ websites located at www.p2phrsolutions.com.au www.career-compass.com.au and www.career-compassp2p.com.au (“Site”). By accessing or using the Site, you agree to be bound by these terms and conditions.

You may purchase services through the Site including; Career Research, Coaching and Planning, Psychometric assessments, Resume preparation and management, Interview training and other career transition and coaching services (“Services”).

The Site is operated by People2People Recruitment Pty Limited trading as People2People HR Solutions (“we”, “us” or “P2P”). P2P may modify these terms at any time, and such modifications are effective immediately upon posting the modified terms on the Site.

P2P’s privacy policy https://www.people2people.com.au/terms-conditions applies for the benefit of users of the Site.

No Employment Placement Services Offered on the Site

By accessing and using the Site or by purchasing access to any Services through the Site, you acknowledge and agree that P2P is not;

  1. acting as your agent or representative in any capacity including as an agent seeking to find you employment; and
  2. providing you with “employment placement services” as that term is defined in section 48 of the Fair Trading Act 1987 (NSW).

If you require employment placement services, you must enter into a separate agreement with P2P under which no fee will be charged. For the avoidance of doubt, as a candidate, there is no requirement for you to purchase access to the Services on the Site if you require employment placement services. If you are a job seeker, P2P will not charge you a fee for the provision of employment placement services alone.

Password and Login

After receipt of payment from you, P2P will issue to you a login name and password to enable you to access the Services and certain features of the Site. You are entirely responsible for:

  1. the confidentiality of your password and login name;
  2. any and all activities on the Site that occur under your login name; and
  3. notifying us of any unauthorised use of your login name or any other breach of security known to you.

Please note that there may be a short delay between payment and obtaining access to the Services.

You acknowledge that, as part of the normal function of the Site and the provision of the Services, you may be able to input information into the Site. P2P accepts no responsibility, provides no warranty and makes no representation in respect of the security of any information inputted or uploaded by you to the Site. P2P will not in any circumstances be liable for any loss, corruption or unauthorised use of information inputted or uploaded by you.

Intellectual Property

All intellectual property rights, including copyright and trademarks, in the material on the Site are either owned or licensed by P2P unless otherwise indicated.

Use of Information on Site

Information contained on this Site is for personal use only and may not be sold, redistributed or used for any commercial purpose. Material may be downloaded from this Site for personal, non-commercial use only.


Content from this Site (including code and software) must not be modified, copied, reproduced, republished, uploaded, posted, transmitted or distributed. You must not use this Site for any purpose that is unlawful or prohibited by these terms and conditions.


You may not use data mining, robots, screen scraping, or similar automated data gathering, extraction or publication tools on this Site except with the prior written consent of P2P.

Content Does not Constitute

AdviceThe information published by P2P on the Site is intended to provide general information in summary form. While P2P uses reasonable care in compiling and presenting the information and material on (or accessible) via the Site, we make no representation or warranty whatsoever regarding the accuracy, currency, completeness, adequacy or suitability of that information or the Services.

It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, Services and other information provided on or through the Site.
P2P will not be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon the Services or on any information contained in or omitted from the Site.

P2P Does Not Endorse Other Sites to Which it Links

P2P may provide links and pointers to other websites maintained by third parties. Such linked sites are not under the control of P2P and P2P is not responsible for the contents of any linked site or any link contained in a linked site.

Service is Not Guaranteed

P2P provides no warranty to you that the Services or the Site will be uninterrupted or error-free or that defects in the Site or the Services will be corrected. P2P accepts no liability for information available for downloading through the Site or delivered via electronic mail. It is your responsibility to ensure such files do not contain infection or viruses, worms, Trojan horses or other code that manifests contaminating or destructive properties.

Security of Your Information

P2P does attempt to ensure the privacy and integrity of the information you provide, however, the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored on our systems or on the Site. P2P disclaims all liability to you to the greatest extent possible pursuant to law should this occur.

Limitation of Liability

Except where we are unable to exclude our liability by legislation, we, our officers, employees, agents and contractors will not be liable in any way to you or anyone else for any loss or damage, however it arises (whether in contract, tort including negligence, or otherwise) out of or in connection with your access and use of the Site or the Services.

In the case of Services supplied or offered via the Site, liability for a breach by us of an implied term which cannot be excluded by legislation, is limited (at our discretion) to either, the supply of the Services (or the equivalent services) again or the payment to you of the cost of having the Services supplied to you again.

Under no circumstances will we be liable to you (or anyone else) for any indirect, consequential, special, punitive or other damages that you or others may suffer, as well as any damages for loss of profit, business interruption or the loss of data or information, even if we are informed of the possibility of such loss or damage.

General

The laws governing this agreement will be the laws of New South Wales. The Courts of New South Wales will have jurisdiction to hear disputes arising from these terms.

Termination

P2P may, in its sole and unfettered discretion, terminate a user’s access to the Site or the Services for breach of these terms.
